Amy Brody is a partner at Rakoczy Molino Mazzochi Siwik LLP.  Ms. Brody handles a wide variety of complex commercial litigation, pharmaceutical and Hatch-Waxman statutory patent litigation, and insurance coverage and reinsurance disputes.

Complex Commercial Litigation

Ms. Brody's work in the commercial litigation arena has ranged from representing private equity clients to international insurance/ reinsurance companies and pharmaceutical companies in a variety of national and international disputes, including complex contract, tort, fraud, and antitrust claims.  Ms. Brody's work in this area has given her extensive experience in discovery issues, pre-trial and trial phases of federal court litigation.

Along with partner William Rakoczy, Ms. Brody also assisted in obtaining a $6.4 million judgment on behalf of two private equity clients in an action for breach of an investment and securities agreement.

Patent Litigation

Ms. Brody's practice also focuses on patent infringement and regulatory lawsuits, primarily brought under the Hatch-Waxman Amendments to the Federal Food, Drug, and Cosmetic Act for pharmaceutical products, and the Administrative Procedures Act. Her work in this area has given her experience in litigation involving such blockbuster drugs as Neurontin® (gabapentin), Paxil® (paroxetine hydrocholoride), and Zoloft® (sertraline hydrochloride).

Reinsurance/Insurance Coverage

Ms. Brody has been further involved in numerous cases involving international reinsurance companies, in which she has gained both litigation and arbitration experience. Her work in this area has involved disputes under various reinsurance treaties and excess indemnity policies.

Ms. Brody's successes in this area include assisting in obtaining a $25.3 million damage award in favor of one of the largest reinsurance companies in the world in an arbitration against a cedent insurance company. Even more recently, Ms. Brody assisted in obtaining a favorable summary judgment ruling on behalf of this same reinsurance company and its affiliates in a breach of contract and insurance bad faith action, which involved piercing the corporate veil and punitive damages claims.

Ms. Brody's work has also extended to work in the area of directors and officers liability. For this area of work, Ms. Brody has analyzed insurance coverage issues under non-profit liability insurance policies, directors and officers and company reimbursement insurance policies, and combined   directors & officers, fiduciary and crime insurance policies in connection with securities fraud claims, fidelity losses, and discrimination and other employment disputes.

Prior to joining Rakoczy Molino Mazzochi Siwik LLP, Ms. Brody was an associate at Lord, Bissell & Brook LLP.
