Alice Riechers is a partner at Rakoczy Molino Mazzochi Siwik LLP. Her practice primarily focuses on pharmaceutical patent litigation. In addition, Ms. Riechers handles a variety of complex commercial litigation, pharmaceutical regulatory counseling, and federal legislative issues involving the pharmaceutical industry.
Patent Litigation
Ms. Riechers' practice focuses primarily on pharmaceutical patent litigation. She has extensive experience in all areas of pharmaceutical and Hatch-Waxman litigation, including participating extensively in pre-suit strategy development, all aspects of fact, damages, and expert discovery, pre-trial and trial preparation, and appellate briefing.
Ms. Riechers has been a key member of multiple litigation teams, including those involving such drugs as Altace® (ramipril); Olux® (clobetasol propionate foam); Plexion® (sodium sulfacetamide and sulfur); Mircette® (Desogestrel, Ethinyl Estradiol and Ethinyl Estradiol); Vanos® (fluocinonide); Monistat® (miconazole); and Taxol® (paclitaxel).
Ms. Riechers has been a key member of multiple litigation teams that have defeated motions for preliminary injunctions, either keeping her clients' product on the market or paving the way for her clients to launch generic products. She has also been a key member of litigation teams that have taken complex pharmaceutical patent cases to trial, and subsequently was extensively involved in appeals to the U.S. Court of Appeals for the Federal Circuit.
Complex Commercial Litigation and Regulatory Counseling
In addition to Ms. Riechers' experience in pharmaceutical patent litigation, Ms. Riechers' work in the commercial litigation area has been diverse. She has represented numerous clients in various complex commercial matters, including complex contract, tort, and fraud claims. Ms. Riechers' work in this area has given her extensive experience in discovery matters, pre-trial and trial phases of federal and state court litigation, as well as experience at the federal appellate level.
She has been involved with litigating pharmaceutical regulatory issues involving the U.S. Food and Drug Administration ("FDA"), assisting clients with the filing of Abbreviated New Drug Applications ("ANDAs"), assisting clients with responses to FDA deficiency letters as part of the ANDA approval process, and responding to citizen petitions filed with FDA which were designed to delay her client's market entry.
Ms. Riechers also has considerable experience working with the United States Pharmacopeia ("USP"), a standards setting organization. She has, for example, assisted clients by addressing proposed produce monographs that potentially presented obstacles to the marketing of generic drug products.
Previous Experience
Prior to joining Rakoczy Molino Mazzochi Siwik LLP, Ms. Riechers was a litigation associate at Winston & Strawn LLP.
